Bluesmith LLC ("Bluesmith," "we," "us") is a marketing automation and web agency based in Fresno, California. We build and operate lead-handling systems on behalf of the local service businesses we work with ("Clients"). This policy explains what information our systems collect, how it is used, who it is shared with, and how to have it removed.

1. Who this policy covers

This policy applies to:

• Consumers who submit a lead form, quote request, or contact form run by Bluesmith on behalf of a Client, including forms on Facebook, Instagram, and Client websites.

• Clients whose business data, accounts, and platforms Bluesmith connects to in order to deliver services.

• Visitors to bluesmith.us.

2. Information we collect

From lead forms (including Meta Lead Ads): the information you type into the form, which may include your name, phone number, email address, street address, city, ZIP code, the service you are asking about, whether you own the property, and your answers to any qualifying questions. We also receive technical details from the platform, such as the form ID, campaign name, ad name, and the time the form was submitted.

From Clients: business contact details, platform access you grant us (for example, access to a Facebook Page, ad account, or CRM), and the records inside those systems that are needed to deliver the service.

From bluesmith.us: standard server logs and analytics such as pages viewed, browser type, and approximate location derived from your IP address. We do not sell this data.

We do not knowingly collect information from anyone under 18.

3. How we use it

We use lead form information for one purpose: to get your request to the business you asked to hear from, as quickly as possible. Specifically, our systems:

• Record your submission in a secure log kept for the Client.

• Check basic qualification criteria the Client has set (for example, service area).

• Create or update your record in the Client's customer management system (for example, Jobber).

• Notify the Client by text message and email that you have asked to be contacted.

We use Client information to configure, run, monitor, and support the services the Client has engaged us for.

We use website analytics to understand how bluesmith.us is used and to improve it.

4. Who we share it with

The Client you contacted. Your lead information is delivered to the business you submitted the form to. Once it reaches them, their own privacy practices apply. We do not share your lead information with any other business.

Service providers that run our systems. We use third-party platforms to process data on our behalf. Currently these include Meta Platforms (lead form delivery), Google (Google Workspace and Google Sheets for secure logging), Twilio (text message delivery), Jobber (Client customer management), and Hostinger (hosting for our automation server). Each processes data only as needed to provide its service to us.

Legal requirements. We will disclose information if required by law, subpoena, or court order, or to protect the rights, safety, or property of Bluesmith, our Clients, or others.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third party, except with the messaging provider that delivers the messages (currently Twilio).

5. Meta Platform data

When a Client runs lead ads on Facebook or Instagram, Bluesmith retrieves lead submissions through Meta's Lead Ads API on the Client's behalf. Our use of information received from Meta platforms complies with the Meta Platform Terms and Developer Policies. We access only the lead data for pages and forms the Client has authorized, and we use it only as described in this policy.

6. How long we keep it

Lead records are kept for as long as the Client engagement is active and for up to 24 months afterward, unless the Client requests earlier deletion or the law requires longer retention. Text and email notification logs are kept for 12 months. Website analytics are kept in aggregate form.

7. Your choices and rights

Deleting your data. You can ask us to delete the lead information we hold about you at any time. Email jacob@bluesmith.us with the name and phone number or email you submitted, and we will remove your record from our systems within 30 days and confirm by reply. Note that the Client you contacted may hold their own copy; you can contact them directly to request deletion there.

Correcting your data. Email the same address to correct any information.

Text messages. See Section 8 for the full text messaging program terms, including how to opt out.

California residents. Under the CCPA/CPRA you have the right to know what personal information we collect, to request deletion, to correct inaccurate information, and to not be discriminated against for exercising these rights. We do not sell or share personal information as those terms are defined under California law. Submit requests to jacob@bluesmith.us. We may need to verify your identity before acting on a request.

8. Text messaging (SMS) program terms

Program description. Bluesmith operates text messaging on its own behalf and on behalf of its Clients. Messages may include: (a) lead, appointment, and system notifications sent to Client business owners and their staff; and (b) where a consumer has opted in, appointment confirmations and reminders, quote and estimate follow-ups, service updates, and replies to questions from the Client they contacted. Messages are transactional and conversational. We do not send unsolicited marketing texts.

How you opt in. You agree to receive text messages by submitting a form that discloses text messaging, by checking a consent box, by replying to a message we or a Client send you, or by giving your mobile number to a Client for the purpose of being contacted about your request. Consent to receive text messages is not a condition of purchasing any goods or services.

Message frequency. Message frequency varies based on your interaction with the Client.

Cost. Message and data rates may apply. Contact your wireless carrier for details about your plan.

How to opt out. Reply STOP to any message to stop receiving texts from that sender. You will receive a one-time confirmation that you have been unsubscribed. After that, no further messages will be sent to your number from that sender unless you opt in again. Reply START to resubscribe.

Help. Reply HELP to any message for assistance, or contact us at jacob@bluesmith.us or (844) 793-9037.

Carriers. Wireless carriers are not liable for delayed or undelivered messages.

Privacy. Mobile numbers and opt-in consent records are used only to deliver the messages described above. They are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.

9. Security

We protect data with access controls, encryption in transit, credential management that keeps API keys and tokens out of application code, and least-privilege access for our team. No system is perfectly secure, and we cannot guarantee absolute security.

10. Changes to this policy

We may update this policy from time to time. The effective date at the top reflects the latest version. Material changes will be posted on this page.
